The terms for using October, connecting your tools, and building with our open-source projects.

These terms govern your use of October’s website, desktop application, companion experiences, and hosted services offered by Wega Labs Inc, a United States company. By using those services, you agree to these terms. If you use October for an organization, you must have authority to accept them on its behalf.
You must be at least 13 and meet the minimum age required where you live. If you are not old enough to enter into an agreement, a parent or legal guardian must authorize your use and accept these terms. Our Privacy Policy explains how information is processed; using the service is not a substitute for consent where the law requires consent.
Separately licensed open-source software is governed by its own license. These terms apply to October-hosted services you choose to connect to it.
October Desktop is a workspace for people and AI agents: terminals, repositories, files, previews, shared canvases, connected machines, and coordinated work. Optional services can include assistant features, Runs, collaboration, remote access, online voice, cloud workspaces, and model usage.
October Bus provides coordination between independent agents and harnesses. October Harness and other open-source projects provide additional tools and building blocks. Available features depend on the software version, platform, connected providers, and the plan or offer you use. Research projects and roadmap descriptions are not commitments to deliver a particular feature.
We grant you a limited, non-exclusive license to install and use the proprietary portions of October Desktop for your own or your organization’s work, subject to these terms and your purchased rights. We retain rights in our proprietary software and branding. Your content and separately licensed open-source components are covered below.
Provide accurate account information, protect credentials and API keys, and tell us promptly about suspected unauthorized access. You are responsible for people and software you authorize to use your account or workspace, subject to protections required by law.
Agents can read and change files, execute commands, use network services, and act on connected machines within the permissions available to them. Choose access and approval settings carefully, review important actions and results, and maintain backups. Collaboration or an agent-to-agent message does not itself grant rights to someone else’s systems or data.
You must have permission to connect repositories, devices, accounts, data, and services. Sharing a workspace or enabling remote access can expose its content and controls to authorized participants. Third-party model or infrastructure charges may apply when you use your own accounts.
Legitimate automation through agents, APIs, SDKs, and October Bus is part of the product. Use it lawfully and within the permissions, service limits, and provider terms that apply.

Nothing here limits activities permitted by an applicable open-source license or rights that the law does not allow us to restrict.
You retain your rights in the code, files, prompts, designs, and other material you provide. You grant us a limited, non-exclusive license to host, process, transmit, and display that material as needed to provide the services you use, carry out your instructions, support your account, and maintain service security. That includes processing by relevant service providers and sharing with participants you authorize. The Privacy Policy explains related data handling and logging.
We do not claim ownership of your projects merely because you use October. You are responsible for having the necessary rights to the content you submit or share.
AI output can be incorrect, insecure, incomplete, or similar to someone else’s output. Review code, commands, changes, and conclusions before relying on or publishing them. A completed Run or review is not a guarantee of correctness or safety. Rights in AI output may depend on applicable law, third-party rights, and the terms of the model provider.
Each open-source project, including October Bus and October Harness, is provided under the license included in its repository or distribution. That license controls your rights to use, inspect, modify, and redistribute the covered software. These website terms do not replace or take away those rights.
Some components have separate upstream licenses, notices, or contribution terms. Follow the terms for the components you use. Making code available does not automatically license October’s trademarks or unrelated proprietary software.
A paid October plan buys the services or entitlements stated in the offer. It is not required merely to exercise rights already granted by an open-source license, and it does not automatically include support or hosting for a self-hosted deployment.
The price, currency, billing interval, included usage, and material offer conditions are disclosed before purchase. October Desktop plans, Harness model-usage subscriptions, and API credit packs are separate offers unless expressly bundled. Taxes may apply. An offer’s specific purchase terms control its pricing, credits, duration, and refund window; mandatory consumer rights always apply.
Subscriptions renew at the disclosed interval until canceled. Cancel through the available billing controls or contact us before the next renewal to avoid that charge. Canceling normally stops future renewals and leaves access through the paid period; it does not automatically refund an already-paid period, except as required by law or the offer. Failed payments may interrupt paid features.
One-time purchases do not automatically renew. Usage credits apply to the service and limits stated in the offer. Any expiry date, reset schedule, promotional restriction, or rollover rule disclosed at purchase applies. Do not assume that a credit pack includes unlimited usage or a new usage window with every purchase. Expiring promotional API packs use their stated use-by date.
Founding purchases keep their purchased rights. Founding Pro Forever is a one-time software-tier entitlement for the commercially available lifetime of October, with the stated 14-day refund period. Recurring model, voice, or compute allowances are included only where the purchased offer says so. This update does not remove an existing customer’s purchased entitlement.
Refund requests go to harsh@wegalabs.com. Refund and cancellation conditions disclosed with your purchase apply alongside rights required by law. We will disclose material renewal or price changes before they take effect and obtain consent where required.
Third-party harnesses, model providers, hosting services, repositories, plugins, and integrations have their own terms, privacy practices, limits, and availability. Using October does not give you rights to those services beyond your authorization or subscription. API credits supplied through a service such as Concurred are also subject to the specific offer and any separately disclosed service terms.
We may update software, change integrations, or interrupt service for maintenance, security, or operational reasons. We do not guarantee continuous availability or continued support for every third-party model or tool. These changes remain subject to existing purchase commitments and applicable law.
You may stop using October at any time. Uninstalling the app does not cancel a subscription; use billing controls or contact us to cancel at the end of a billing period. You can delete your account in October Mobile (Settings → Account → Delete account) or at october.dev/delete-account. Deleting your account cancels any subscription immediately and ends access to paid features and remaining credits at once; it does not waive refund or other rights you have under applicable law or your purchase terms. The Privacy Policy explains what is deleted and what is kept.
We may suspend or end hosted access for material violations, unlawful or abusive activity, security risks, unpaid charges, or legal requirements. We will provide notice and an opportunity to resolve issues where reasonable and lawful. Any service discontinuation remains subject to purchased rights and legally required remedies.
Export hosted work before an applicable retention window ends. Ending hosted access does not transfer ownership of your local files or revoke rights granted by a separate open-source license. Payment obligations, ownership provisions, liability limits, and other terms that need to continue will survive termination as applicable.
To the extent permitted by law, October is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service or AI output will be accurate, uninterrupted, or error-free.
To the extent permitted by law, Wega Labs Inc is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data. Our total liability for claims relating to the service is limited to the amount you paid us for it in the 12 months before the event giving rise to the claim. These limits do not exclude liability or remedies that cannot lawfully be excluded or limited.
If you use October for a business, you agree, to the extent permitted by law, to indemnify us against third-party claims caused by your unlawful use, infringing content, or material breach of these terms. This does not cover claims caused by our own breach or misconduct.
These terms are governed by applicable laws of the United States, subject to mandatory consumer protections that apply where you live. A dispute may be brought before a court with jurisdiction under applicable law. These terms do not impose mandatory private arbitration.
Please contact harsh@wegalabs.com about a dispute so we can try to resolve it. Nothing in this section prevents you from exercising a legal right or seeking a remedy available under applicable law.
We may update these terms as October evolves. We will publish the revised version and its date, provide notice of material changes, and follow any notice or consent requirements that apply. Updated terms do not retroactively remove purchased rights. If you do not accept a material change, you may stop using the affected services, subject to applicable purchase and consumer rights.
If a provision cannot be enforced, the remaining provisions continue to apply. These terms, the relevant purchase terms, and any separate written agreement with us govern the covered service. Separate open-source licenses continue to govern their covered software.
